Present appeal was presented in the Registry of this Court on 20.07.2000 by appellant No.1-Ram Narain S/o Sri Parag Kurmi, appellant No.2-Sant Ram Kurmi S/o Sri Satgur Bairag and appellant No.3-Raj Kumar Kurmi S/o Sri Ram Autar. The appellants were enlarged on bail by this Court vide order dated 21.07.2000. During pendency of the appeal, a report was submitted by the C.J.M., Raibareli on 09.05.2025 and taking note of the same, the appeal was dismissed as abated for appellant No.2-Sant Ram Kurmi vide order dated 14.05.2025, which reads as under:- "In deference to the previous order dated 09.04.2025 passed by this Court, the Chief Judicial Magistrate, Raebareli has sent a report dated 09.05.2025 intimating therein that appellant no.1- Ram Narain son of Parag Kurmi and appellant no. 3 / Raj Kumar son of Ram Autar have died. The report has been sent alongwith death certificates issued by the Government and the statements recorded by the Chief Judicial Magistrate. However, death certificates are blurred and not readable. In view of the above, let readable copies of the death certificates of appellant no.1 and appellant no. 3 be called from C.J.M. concerned. Appellant no.2/ Sant Ram Kurmi has also died in regard to which the appeal has been abated. List this case on 27.05.2025." After the aforesaid order dated 14.05.2025, the appeal was dismissed as abated for appellant No.1-Ram Narain vide order dated 27.05.2025. This order was passed based upon the death certificate of appellant No.1-Ram Narain. With regard to appellant No.3-Raj Kumar Kurmi the fresh report was sought from the C.J.M., Raebareli vide order dated 27.05.2025. The order dated 27.05.2025 is reads as under:- "In deference to the order dated 14.05.2025 passed by this Court, the Chief Judicial Magistrate, Raebareli has sent the copies of the available death certificates of the appellant nos.1 and 3 through letter dated 26.05.2025. The appellant no.1-Ram Narain son of Parag Kurmi has died on 29.05.2024, as per the death certificate issued by the Government of Uttar Pradesh under the signatures of Registrar (Birth & Death), Gram Panchayat Chichauli. In view of the above, the appeal stands abated on behalf of appellant no.l- Ram Narain. Other death certificate is of Raj Kumar Verma son of Ganesh Prasad Verma who died on 02.05.2019 whereas the appellant no.3 is Raj Kumar son of Ram Autar, resident of Nawa Pur, Police Station- Jamo, District- Sultanpur. In view of the above, let a report be called from the Chief Judicial Magistrate, Raebareli as to how a wrong certificate has been forwarded by the Police Station which has been forwarded by him without verifying it. List this case on 03.07.2025." In view of aforesaid, present appeal is also dismissed as abated for appellant No.3-Raj Kumar Kurmi.
