Neutral Citation No. - 2025:AHC-LKO:1966 Court No. - 15 Case :- CRIMINAL MISC ANTICIPATORY BAIL APPLICATION U/S 438 CR.P.C. No. - 29 of 2025 Applicant :- Prag Madhav Singh And 3 Others Opposite Party :- State Of U.P. Thru. Addl. Chief Secy. Home Deptt. Lko. And Another Counsel for Applicant :- Prem Prakash Singh Counsel for Opposite Party :- G.A.,Syed Mehfuzur Rehman,Vikas Vikram Singh Hon'ble Shree Prakash Singh,J. Heard learned counsel for the applicant, learned AGA for the State and perused the record. The instant anticipatory bail application has been filed on behalf of the applicants with the prayer to release them on anticipatory bail in Case Crime No.0192 of 2024, under Sections 420,467, 468, 471, 504 and 506 I.P.C., Police Station Jahangeerganj, District Ambedkarnagar. Contention of the learned counsel for the applicants is that the applicants have no involvement in committing the offence and they have been falsely implicated. He further submits that the matter is pending in appeal before the court of Sub Divisional Officer, Aalapur and matter pertains to civil dispute. He further submits that there is no ample evidence against the applicants and they are co-operating with the investigating proceedings, thus, they may be granted anticipatory bail. On the other hand, learned counsel for the complainant has vehemently opposed the contention aforesaid and submits that the complainant is a widow lady and her husband died in 1996 and the applicants, while fabricating in the document, have committed fraud and, thus, they are not entitled to any relief. Learned A.G.A. has also supported the version of the learned counsel for the complainant and submitted that the applicants are not entitled to any relief. Having heard the learned counsel for the parties and after perusal of record, it transpires that the complainant is a widow lady and her husband died in 1996 and there is specific allegation that the applicants has committed cheat and fraud and since the complainant is a widow lady, therefore, there is acute chances that evidence would be tampered or she would be threatened.
Considering the complicity of the accused and the gravity of offence, this Court do not find any good ground to intervene in this matter. Consequently, the instant anticipatory bail application is hereby dismissed. Consigned to records.
