By means of this petition filed under Article 226 of the Constitution, the petitioner has prayed for following relief as substantial relief: "i) To issue a writ, order or direction in the nature of Mandamus commanding the respondent no.2, Chief Engineer Minor Irrigation Department, Government of U.P. Lucknow, to sanction Third Assured Carrier Progression Pay Band-2 in the grade of Rs.15,600/- Rs.39,100/- grade salary Rs.7600/- level 12, to the petitioner and to grant Third Assured Carrier Progression from 01.11.2000 and to pay the arrears of the benefit of Third Assured Carrier Progression from 01.11.2020 to till the date of retirement i.e. 28.02.2023 with interest at the rate of 12% till the date of actual payment, forthwith, in the interest of justice. ii) To issue a writ, order or direction in the nature of mandamus to the respondent no.2, Chief Engineer Minor Irrigation Department, Government of U.P. Lucknow to decide the representation dated 29.09.2024 (Annexure No.3 to this writ petition), within stipulated period as fixed by this Hon'ble Court." It appears from the records that the petitioner has already represented the matter to the respondent no. 2. Learned Standing Counsel submits that he has no objection in the event this petition stands disposed of with a direction to the respondent no.2 to look into and consider the grievance of the petitioner and pass appropriate order strictly in accordance with law. In view of the above, this petition stands disposed of with a direction that respondent no.2 shall consider the grievance of the petitioner raised in his representation and decide the same within a period of three months from the date of receipt of certified copy of this order.
