No.2863 of 2025 THE HON’BLE SRI JUSTICE HARINATH.N CRIMINAL PETITION No.2863 OF 2025 ORDER: 1. Heard the learned counsel for the petitioners. 2. The learned counsel for the petitioners submits that the petitioners were arraigned as A.1 and A.2 in C.C. No.203 of 2023 on the file of the Court of the Principal Junior Civil Judge-cum-Judicial Magistrate of First Class, Narasapuram, for the alleged offence under Sections 509 read with 34 of the of the Indian Penal Code 1860. 3. The learned counsel further submits that the dispute between the petitioners and the 2nd respondent is in relation to the laying of a C.C. road in front of the house of the 2nd respondent. It is submitted that though no altercation happened on that day, out of vengeance, the 2nd respondent filed a complaint. The police have conducted a table investigation and filed a charge sheet implicating the petitioners. 4. Considering the submissions of the learned counsel that the petitioners are suffering from age related problems, this Court deems it appropriate to dispose off the criminal petition by dispensing with the presence of the petitioners/A.1 and A.2 in C.C. No.203 of 2023 on the file of the Court of the Principal Junior Civil Judge-cum-Judicial Magistrate of First Class, Narasapuram, subject -3- CRL.P. No.2863 of 2025 to the petitioners filing an undertaking to appear before the trial court as and when required for the purpose of trial. 5. Accordingly, the criminal petition is disposed off. 6.
