Prin. Secy. Lko And 5 Others Counsel for Petitioner :- Ravindra Kumar Mishra,Pradeep Kumar Tripathi Counsel for Respondent :- C.S.C. Hon'ble Subhash Vidyarthi,J.
1. Heard Sri Pradeep Kumar Tripathi, the learned counsel for the Petitioner and Sri Sandeep Chandra, the learned Standing Counsel for the State of U.P. representing all the opposite parties. 2. By means of the instant writ petition, the petitioner has challenged validity of the notification/ letter dated 18.12.2024 issued by the opposite party no. 5-District Programme Officer, District Bahraich and he has sought quashing of the vacancy/ reservation list prepared by the authorities. 3. The learned Standing Counsel has raised a preliminary objection regarding maintainability of the writ petition filed by the Mahila Anganbadi Karmchari Sangh and he has submitted that the 'Sangh' is not an applicant in the selection process and none of the rights of the 'Sangh' has been violated. Therefore, the writ petition filed by Mahila Anganbadi Karmchari Sangh is not maintainable in view of the law laid down by the Full Bench of this Court in Umesh Chand Vinod Kumar & Ors. v. Krishi Utpadan Mandi Samiti & Ors: AIR 1984 All 46. 4. The learned counsel for the petitioner has submitted that while preparing the list, the relevant rules regarding reservation have not been complied with and reservations have been made in excess of the number of seats provided by law. 5. The learned Standing Counsel has submitted that the list annexed with the writ petition relates to the year 2022. He has placed before the Court written instructions received from the District Programme Officer, Bahraich, as per which the number of seats regarding which the benefit of reservation has to be provided, has been recalculated and a fresh list has been prepared by a committee headed by the District Magistrate,
Bahraich, on 20.12.2024 which makes provision for reservation strictly in accordance with law. 6. The instructions provided to the learned Standing Counsel are taken on record. 7. Keeping in view the amended list prepared on 20.12.2004 in view the relevant provisions regarding reservation of seats there appears to be no illegality in the ongoing selection process. 8.
The writ petition is dismissed as not maintainable in view of the reasons stated above. Order Date :- 13.1.2025 Pradeep/- Digitally signed by :- PRADEEP SINGH High Court of Judicature at Allahabad, Lucknow Bench
