[2025:RJ-JP:31576] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No. 6994/2007 Ratan Lal S/o Shri Harlal aged about 45 years, R/o Near Police Station Gaon Bhinai, District Ajmer. Presently posted as A.S.I. at Police Line, Ajmer Under Superintendent of Police, Ajmer. ----Petitioner Versus 1. State of Rajasthan through Director General of Police Head Quarter (Police) Rajasthan, Jaipur. 2. Inspector General of Police, Ajmer Range, Ajmer. 3. Superintendent of Police (S.P.) District Ajmer. ----Respondents For Petitioner(s) : Mr. Pushpendra Singh Tanwar with Mr. Rohit Tiwari on behalf of Mr. Shobhit Tiwari For Respondent(s) : Mr. Vinod Kumar Gupta, AGC HON'BLE MR. JUSTICE ANAND SHARMA Order 13/08/2025 1. Only grievance raised by the petitioner is that although vide order dated 29.11.2006, issued by the Superintendent of Police, Ajmer, it has been decided to place the petitioner in the seniority list over and above Shri Ameerchand S/o Lalji Ram however, despite passing such order it was not carried out by the respondents. 2. Learned counsel for the respondents submits that the petitioner has not impleaded aforesaid Shri Ameerchand as party to the writ petition and during the pendency of the writ petition, the petitioner has also retired on account of attaining age of superannuation. [2025:RJ-JP:31576] (2 of 2) [CW-6994/2007] 3. I have considered the submissions made by learned counsel for the parties and perused the record. 4. Since, the petitioner is not seeking determination of seniority over and above Shri Ameerchand, as it has already been done by the respondents themselves by way of issuing order dated 29.11.2006 (Annex.-7), therefore, in my considered opinion there is no requirement to implead Shri Ameerchand as party to the writ petition. Even if, the petitioner has retired during the pendency of the writ petition, he cannot be deprived of his legitimate rights, if any, in consequence of the order dated 29.11.2006. 5. I find no justification in not carrying out the order passed way back on 29.11.2006 whereas, till date the order is in existence, and admittedly has not been withdrawn by the respondents. 6. In view of the above, the writ petition filed by the petitioner is disposed of with a direction to the respondents to issue modified seniority list in accordance with order dated 29.11.2006 by placing name of the petitioner over and above Shri Ameerchand S/o Lalji Ram and in case, the petitioner is entitled for any consequential benefits on account of aforesaid modification in the seniority list, same shall also be granted and released to the petitioner within a period of three months from the date of receipt of certified copy of this order.
