JUSTICE ANISH DAYAL O R D E R % 19.08.2025 CM APPL. 40521/2025 (recall of order dated 20th May 2025) 1. This application seeks recall of order dated 20th May 2025 passed by this Court. 2. It is averred in the application that while the order records that ‘no one appears for petitioner’, proxy counsel had appeared through video conferencing; moreover, it is pleaded that no copy of status report filed by the Municipal Corporation of Delhi (‘MCD’) has been supplied to the petitioner or his counsel. 3. It is, however, quite clear from the order as recorded, that there was no one available on behalf of the petitioner. If the proxy had been available, his/her presence would have been recorded. However, on the second issue, since counsel for petitioner states that he did not have a chance to go through the status report, filed on affidavit, on the basis of which the contempt petition was disposed of, to give him that opportunity, copy of the status report, filed on affidavit, is being supplied by Mr. Manu Chaturvedi, Standing Counsel for MCD via e-mail to Mr. Manoj Kumar Dwivedi, counsel for the petitioner. 5. Mr. Manu Chaturvedi has additionally pointed out that the same petitioner, Mr. Anil Dutt Sharma, has filed various litigations in this Court, a chart of which has been handed up to this Court. Same shall be filed on record of this Court before the next date. 6. Mr. Manu Chaturvedi contends that perusal of the chart would reveal that there are at least 10 separate matters in which orders have been passed by various Benches of this Court. He points out that as tabulated in the said chart, in W.P. (C) 9572/2023 by order dated 20th July 2023, the Court observed that "the petitioner is, therefore, in the habit of filing unnecessary petitions before this Court.” and “the present petition was nothing but an abuse of process of law”. In yet another matter in LPA 104/2023 vide order dated 23rd February 2023, the Division Bench of this Court observed that “A perusal of review petition also shows that the petitioner is a habitual litigant and is guilty of filing frivolous petitions”. 7. Mr. Manu Chaturvedi points out that similar observations have been made by various other Benches of this Court. 8.
