Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the State. 2. The learned counsel for the petitioner submits that the petitioner was arraigned as A.4 in Crime No.646 of 2023 of Machavaram Police Station, Vijayawada, registered for the alleged offence under Section 370(A) (2), 370(3) and Sections 3,4,5 and 7 of the Immoral Traffic (Prevention) Act, 1956. 3. The learned counsel further submits that the petitioner was implicated in the complaint based on the confession of the co- accused and the victims. The learned counsel further submits that the offences alleged against the petitioner are punishable below 7 years and, therefore, seeks a direction to the police to follow the procedure provided under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 4. Considering the submissions of the learned counsel for the petitioner, the Station House Officer, Machavaram Police Station, Vijayawada, is directed to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 for the purpose of investigation in connection with Crime -3- CRL.P. No.3340 of 2025 No.646 of 2023. This order would not preclude the investigation officer to file charge sheet or final report after completion of investigation. 5.
