1. Impugned in this appeal filed by the appellant under Section 21 of the NIA Act, 2008 is an order dated 25.09.2024 passed by the court of Additional District & Session Judge (Designated Court under NIA Act), Kupwara in challan No. 03/2024, whereby the Designated Court has framed charges against the appellant.
2. It is now well settled that an order framing charge is an interlocutory order, and, therefore, not appealable under Section 21of NIA Act. This issue has been set at rest by the Division Bench of this Court in its judgment dated 16.02.2023 passed in CrlA (S) No.13/2022 titled as
“Ayaz Ahmad & anr.Vs. UT of J&K & Ors.”
3. In view of the aforesaid, this appeal is found not maintainable, the same is accordingly dismissed with
the liberty to the appellant to work out its remedy as may be available to him under law.
