JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 2 14-10-2025 Heard learned counsel for the petitioner and the State. 2. Petitioner apprehends arrest in case registered for the offences punishable under Sections 303(2), 334(1) of the Bharatiya Nyaya Sanhita. 3. As per F.I.R., unknown persons committed theft of 150 sacks of fertilizer from the shop of informant on 17.7.25. It is further alleged that theft was also committed in the Kirana shop of Subhash Kumar and hardware shop of Rajendra Yadav. During investigation, one co-accused, namely, Mantu Kumar was apprehended who disclosed that the stolen sacks of fertilizer were sold to this petitioner. Thereafter, rented house of the petitioner was searched from where one sack of NPK fertilizer was seized. 4. Learned counsel for the petitioner submits that Patna High Court CR. MISC. No.72011 of 2025(2) dt.14-10-2025 2/2 petitioner is innocent and has committed no offence. Petitioner is not named in the F.I.R. and has falsely been implicated in this case merely on suspicion. 5. Considering the nature of accusation and the fact that one sack of NPK fertilizer was recovered from the house of this petitioner, prayer for anticipatory bail of the petitioner is refused.
