Neutral Citation No. - 2025:AHC-LKO:26030 Court No. - 6 Case :- WRIT - A No. - 14241 of 2017 Petitioner :- Mohd Javed Respondent :- Distt Judge Raebareli And Ors Counsel for Petitioner :- Ashutosh Kumar Srivastava Counsel for Respondent :- Bireshwar Nath Hon'ble Pankaj Bhatia,J.
1. A request for adjournment has been made on behalf the petitioner, however, as the matter is very old one, I am not inclined to adjourn the matter.
2. The present petition has been filed challenging the orders dated 19.05.2009 passed under section 21(1)(a) of the U.P. Act No. 13 of 1972 as well as the order dated 28.04.2017 whereby the appeal was dismissed.
3. An attempt was made to argue that the person who had moved the release application was not the owner. This fact was adequately dealt with by the appellate court wherein it was recorded that the opposite parties were the joint owner of the property in question through succession and in any case, it was also recorded that the relationship of landlord and tenant existed.
4. Clearly the petitioner being a tenant wants to delay the execution proceedings by adopting delaying tactics, warranting no interference.
5. The petition lacks merit and is dismissed.
6. Let a copy of this order be sent to the trial court for execution in accordance with law. Order Date :- 5.5.2025 VNP/- Digitally signed by :- VISHVANATH PRASAD SHUKLA High Court of Judicature at Allahabad, Lucknow Bench
