Heard Sri Udai Bhan Pandey, learned Counsel for the petitioner, learned A.G.A. and perused the records. 2. In view of order proposed to be passed, issuance of notice to the private-respondent(s) is hereby dispensed with. 3. The present petition has been filed for the following main reliefs:- "(1) to issue a writ, order or direction in the nature of Certiorari quashing the impugned summoning order dated 2.7.2013 passed in Revision No. 111 of 2013 (Raju Misra and others Vs. Ram Babu) contained as Annexure No. 1 to this writ petition." 4. The brief facts of the case are to the effect that a sale deed was executed on 03.11.2011 by the petitioner-Ram Babu in favour of Smt. Veena Misra, which was registered on 04.10.2011 and thereafter with regard to the same property another sale deed was executed in favour of Smt. Ashok Kumari, which was registered on 13.10.2011. 5. Aggrieved by the aforesaid, an FIR against the petitioner and others was lodged by Smt. Veena Misra, which was registered as Case Crime No. 1012 of 2011 under Section 419/420 IPC, Police Station Kotwali Nagar, District Gonda. 2 6. Thereafter another FIR was lodged by Smt. Ashok Kumari in whose favour second deed was executed by the petitioner, which was registered as  Case Crime No. 1060 of 2011 under Section 419/420 IPC, Police Station Kotwali Nagar, District Gonda. 7. After the aforesaid, the petitioner filed complaint case impleading private opposite party no.(s) 2 to 6 namely Raju Misra, Sri Dhar, Smt. Veena Misra, Rajesh Kumar and Maheswari. This complaint case was registered as Case No. 2111/2011 (Ram Babu Versus Rajeev Mishra and others) and Magistrate taking note of the statement recorded before it in terms of Section 200 and 202 Cr.P.C. vide its order dated 28.01.2013, summoned Raju Misra s/o Shridhar, Shridhar s/o Chote Lal, Smt. Veena Misra w/o Raju Misra, Rajesh Kumar s/o Mishri Lal and Maheswari s/o Ganpat. 8. The above named persons challenged the order dated 28.01.2013 by means of Criminal Revision no. 2111/2011 (Raju and four others Versus Ram Babu and State). The revisional court set aside the order dated 28.01.2013 passed by the Magistrate concerned, vide impugned order dated 02.07.2013. Relevant portion of the order dated 02.07.2013 reads as under:- "पक्षकार अधि वक्ताओं का सुना गया एव पत्रावली का अवलीकाना किकाया गया। धिनागरनाकार्ता का द्वार धिनागरना में प्रथमें सु"चना रिरपर्ट अपर सु ख्या 1060/11 अन्र्तागर्ता र 419,420, आकि), थना कार्तावली नागर गण्डा )खि-ली का. गया है0। खि1सुका अवलीकाना किकाया गया। याहै प्रथमें सु"चना रिरपर्ट श्रीमेंर्ता अशोका का मेंर4 खि1सुका हैवली परिरव) में कि)या गया है0 का द्वार धिनागरनाकार्तागण का विवरूद्ध सु खि9थर्ता कारया गया है0 र्ताथ याहै प्रथमें सु"चना रिरपर्ट उन्है4 र्ताथ्या< पर है0 खि1ना र्ताथ्या< पर परिरव) सु खि9थर्ता है0। उपरक्ता प्रथमें सु"चना रिरपर्ट में वकि)ना द्वार बर्ताया गया है0 किका कि)ना का 4.8.11 का विवपक्ष सु ० 2 व 3 उसुका घर आया और उसुसु काहै किका आपका सु9र्ता )र पर 1मेंना -र4)व )"Aग क्याकिका हैमें लीग< का. बर्ता रमेंबब" पत्रा 1यारमें सु है गया है0 1 1मेंना बच रहै हैC। कि)ना का 6.8.11 का विवपक्षगण का सुथ वकि)ना गण्डा काचहैर4 आया वहैA पर वकि)ना ना प0सु कि)या र्ताथ याहै प0सु रमें बब" का कि)या परन्र्ता ब) में रखि19ट्री4 नाहै4 कारया और याहै आश्वासुना )र्ता रहै किका रमें बब" सु रखि19ट्री4 कारव )ग र्ताथ ब) में याहै काहैर्ता रहै किका रमें बब" का. र्ताबयार्ता -रब है गया है0। इसु प्रकार धिनागरनाकार्ता श्रीमेंर्ता बना का द्वार 3 भी परिरव)4 एव अन्या का धिनारूद्ध इसु बवर्ता एका प्रथमें सु"चना रिरपर्ट मेंका)में अपर सु ख्या सु-1012/11 अन्र्तागर्ता र 419,420 आकि), )1 कारया गया है0। अर्ताH 9पष्ट है0 किका खि1ना आ र< पर परिरवकि)ना का द्वार परिरव) सु खि9थर्ता किकाया गया है0 उक्ता आ र पर )ना< पक्ष< का द्वार प्रथमें सु"चना रिरपर्ट )1 है0 एव ऐसु खि9थधिर्ता में उसु आ र पर परिरव) सु चधिलीर्ता किकाया 1ना विवधि सुम्मेंर्ता नाहै4 हैC। अर्ताH विवद्वाना अवर न्यायालीया द्वार परिरर्ता आक्षविपर्ता आ)शो कि)नाकिका र्ता 28-01- 2013 में र्ताखिLवका त्राकिर्ट हैना का कारण धिनार9र्ता किकाया 1ना याग्या है0। र्ता)नासुर धिनागरना 9वकार किकाया 1ना याग्या है0। आ)शो धिनागरना 9वकार का. 1र्ता है0। विवद्वाना अवर न्यायालीया द्वार परिरर्ता आक्षविपर्ता आ)शो कि)नाकिका र्ता 28-1-2013 धिनार9र्ता किकाया 1र्ता है0। पत्रावली अवर न्यायालीया का प्रविNर्ता का. 1व।" 9. It would be apt to indicate that the petitioner has also filed a suit for cancellation of sale deed favourable to Smt. Veena Misra, as appears from record. 10. In the aforesaid background of the case, the present petition has been filed. 11. Upon due consideration of the arguments advanced by learned Counsel for the petitioner  and  learned A.G.A., this Court finds no force in the present petition. It is for the reason that the complaint case filed by the petitioner, is nothing but an abuse of process of law as after two FIRs lodged by the purchasers against the petitioner, to save his skin, filed a complaint case and before this Court there is no evidence to establish that subsequent sale deed was not signed by the petitioner. 12.
