Khakhlary, learned counsel for the petitioners. Also heard Mr. K. Baishya, learned Additional Public Prosecutor for the State. 2. The learned Additional Public Prosecutor has placed the report which was called for from the Officer-In-Charge of the Gorchuk Police Station in respect of this case. It was enquired by this Court whether any FIR has been lodged against the petitioners, namely, (1) Surya Boro and (2) Rebati Boro and whether any case has been registered on the basis of the said FIR in the report furnished by Sri S. Barman, S.I. police of Gorchuk police station. 3. It appears that one Dhiraj Kumar Talukdar had lodged a complaint before the Officer-In-Charge of the Garchuk Police Station, inter alia, alleged that the petitioners had taken an amount in advance from the wife of the informant on pretext of purchasing one plot of land but till date the possession of the same has not been ended. On fair perusal of the said complaint it appears that the matter involved in the case is purely of civil nature. However, considering the fact that the police has not yet culminated the enquiry, this anticipatory bail application is disposed of with a direction that in the event of the enquiry ends in registration of a Police Station case and the petitioners are arrested in the said case, they shall be allowed to go on bail of Rs.30,000/-(Rupees Thirty Thousand each) only with one surety of like amount subject to the satisfaction of the arresting authority with following conditions: i) That the petitioners shall not directly or indirectly make any inducement, threat or promise to any persons who may be acquainted with the facts of the case Page No.# 3/3 so as to dissuade such person from disclosing such facts of the case before the Investigating Officer; ii) That the petitioners shall co-operate in the investigation; 4. With above observations, this anticipatory bail application is disposed of. 5. The report received from the Officer-In-Charge of Garchuk Police Station shall be kept tagged with the record.
