JUSTICE ALOK KUMAR PANDEY ORAL ORDER 2 14-10-2025 Heard the parties. 2. The petitioner seeks anticipatory bail in connection with Kankarbagh P.S. Case No. 744/2025 dated 11.08.2025 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act. 3. As per prosecution case, there is alleged recovery of 12 piece of 180 ML (2.160 litre) liquor and two persons namely, Rahul Kumar and Sanni Kumar were apprehended on motorcycle. 4. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. and his name has surfaced
Patna High Court CR. MISC. No.70907 of 2025(2) dt.14-10-2025 2/3 during investigation as the owner of the motorcycle in question. It is further submitted that at the request of the co-accused Sanni Kumar, the petitioner had given his motorcycle to him to go to the hospital for his treatment and the petitioner had no knowledge that his motorcycle would be used in carrying the liquor. Apart from that, it has also been submitted that the petitioner has no criminal antecedents. In the light of the aforesaid facts, the learned counsel submits that no offence under section 30(a) of the Bihar Prohibition and Excise Act, is made out against the petitioner. 5. Learned APP vehemently opposed the prayer for anticipatory bail. 6. Considering the facts and circumstances of the case and also the fact that the petitioner is not named in the F.I.R. and he has no criminal antecedents, let the petitioner, above named, be released on bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs.
10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Bihar, Prohibition and Excise Act -1st, Patna, in connection with Kankarbagh P.S. Case No. 744/2025,
