In compliance of the earlier orders passed by this court, the Chief Judicial Magistrate Lakhimpur Kheri has sent a report dated 01.01.2025. We have gone through the said report sent by C.J.M. Lakhimpur Kheri wherein it has been stated that the sole respondent Shatrohan S/o Babu Lal Yadav, has died around 16 years ago. The statements of the Village Pradhan, the Sub Inspector of the Police Station concerned and also of near relatives of the respondent, have been enclosed to the said report. Since the sole respondent- Shatrohan S/o Babu Lal Yadav, has died during the pendency of the Appeal, the instant Appeal is liable to be dismissed as abated.
