Heard learned counsel for petitioner and Mr. Rishabh Kapoor learned counsel for opposite parties. Petition has been filed seeking a direction to the concerned authority for release of arrears of salary and pension alongwith interest thereupon. It has been submitted that petitioner superannuated from service on 30th September, 2020 on the post of Assistant Engineer by the opposite parties but the aforesaid benefits have not yet been paid despite the fact that demand has been raised for payment thereof by the Executive Engineer, Construction Division, U.P. Jal Nigam (Urban), Sitapur. For the aforesaid grievance, the petitioner has already submitted a representation but seeks liberty to file a fresh representation before the authority concerned. Considering innocuous prayer being made by learned counsel for the petitioner and without entering into the merits of the case petitioner is granted liberty to file a fresh representation before competent authority. In case such a representation is filed, the same shall be decided within period of six weeks from the date a certified copy of this order is produced before the said authority. In case petitioner is found entitled for the aforesaid benefits, actual payment thereof shall be ensured within a period of six weeks thereafter. The authority concerned shall also address the issue of payment of interest on delayed payment. With the aforesaid directions, the writ petition stands disposed of.
