(2) According to petitioner, he was appointed as Gardner (Mali) on 20.10.1986 in Horticulture Department and, presently, he is serving as Assistant Development Officer at Sachal Dal Kendra, Rani Pokhari, District Pauri Garhwal. According to petitioner, he is entitled to benefit of Assured Career Progression Scheme (ACP) w.e.f. 1.11.2013, however the said benefit has not been given to him so far. He submits that all other employees were given benefit of ACP, therefore denial of same to him is unjust and illegal. (3) Learned State Counsel submits that since the petitioner has sought a direction to the competent authority to grant him ACP, therefore, it would be better if petitioner is permitted to make a representation and the competent authority be asked to take decision thereupon. (4) Accordingly, writ petition is disposed of granting liberty to petitioner to make a representation to Director, Horticulture for grant of ACP. If he makes representation within two weeks from today, Director concerned would take decision thereupon, as per law, within four months thereafter by passing a reasoned order.
