S. No. 79 Suppl. Cause List IN THE HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR CM(M) No. 509/2025 CM No. 7657/2025 Bashir Ahmad Najar and Ors. …Appellant/Petitioner(s) Through: Mr. Adil Parray, Advocate Vs. Yasmeena Bano ...Respondent(s) Through: CORAM: HON’BLE MR JUSTICE VINOD CHATTERJI KOUL, JUDGE O R D E R 21.11.2025 Petitioners are aggrieved about the proceedings initiated by the Trial Court in a petition titled Yasmeena Bano v. Bashir Ahmad Najar, filed by the respondent seeking various reliefs, including grant of maintenance and passing of a residential order in her favour. Instead of availing the remedies available under law, the petitioners have filed the present petition, which is not maintainable. When a query was posed to the learned counsel for the petitioners regarding the maintainability of this petition, he sought permission to withdraw the same with a request that the Trial Court may be directed to consider the objections of the petitioners pertaining to the maintainability of the proceedings before it. In view of the statement made by the learned counsel for the petitioners, the instant petition is dismissed as withdrawn. The Trial Court is directed to consider and decide the objections regarding the maintainability of the petition expeditiously and without granting unnecessary adjournments.
