HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - C No. - 1003807 of 2014 Court No. - 6 HON'BLE PANKAJ BHATIA, J. 1. Heard, learned counsel for the petitioner and Shri Pawak Kumar Pandey, learned counsel for the respondent. 2. The present petition has been filed by the petitioner, alleging that the list of members was altered without taking into consideration the petitioner's objections regarding the unauthorized inclusion of new members. The learned counsel for the petitioner accepted that after the revision was filed, various elections have taken place. In view thereof, since all these subsequent elections have not been challenged by the petitioner, nothing survives in the present petition 3. The contention of the learned counsel for the petitioner is that since the original petition is from the year 2007, and unless it is decided, all subsequent elections based on the same list of members would ipso facto become infructuous. The said contention contention, however, cannot be accepted, as the learned counsel for the respondent pointed out that subsequent to the filing of this petition, various elections have taken place, and none of them have been challenged by the petitioner. Even otherwise, there is no resolution in favor of the petitioner authorizing him to file this petition at the instance of Committee of Management.
