ADDL ADVOCATE GENERAL (AP) The Court made the following order: Challenging the preliminary notification issued by the 2nd respondent in Ref No G4/497/2019 dated 30.01.2020, proposing to acquire the land of the petitioners to an extent of Ac.2.10 cents in Sy.No 977/1, Ac.0.99 cents in Sy.No 978/2, Ac.0.90 cents in Sy.No 981/1 and Ac.0.49 cents in Sy.No 981/2, Ac.1.00 cents in Sy.No 979/2, Ac.0.94 cents in Sy.No 979/2, Ac.1.27 cents in Sy.No 978/1, Ac.0.99 cents in Sy.No 978/2 and Ac.0.99 cents in Sy.No 979/1 of Mandapet Village and Mandal East Godavari District as illegal arbitrary and contrary to the provisions of the new Land Acquisition Act of 2013 and set aside the same consequently directing the respondents to drop further proceedings including dispossession of the petitioners from the said lands. 2. Heard Sri N.Siva Reddy, learned counsel for the petitioners and Ms.M.Anusha, learned Assistant Government pleader for Land Acquisition appearing for the respondents. 3. Today, when the matter is taken up for hearing, the learned Assistant Government Pleader for Land Acquisition has placed on record a copy of the written instructions received from the 4th respondent, dated 20.02.2025. A perusal of the same would reveal that an alternative land was identified for the purpose of Providing House sites under ‘Navaratnalu-Pedalandariki Illu’ Scheme. Hence, vide proceedings of the Collector, D.Dis.G4/RCPM/MPT/ Mandapeta/497/2019, dated 05.09.2021, the withdrawal notification under Section 93(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, was issued. 4. Since the proposal for acquisition of the present lands has been withdrawn, no further directions are required to be issued. 5. The written instructions of the 4th respondent, dated 20.02.2025 are placed on record. 6. In view of the foregoing, the writ petition is disposed of. There shall be no order as to costs.
