GP FOR SERVICES II 2 HCGR, J W.P.No.7097 of 2025 The Court made the following order: This Writ Petition is filed under Article 226 of the Constitution of India for the following relief/s:- “…to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS to declare the action of the respondents in not considering the case of the petitioner for appointment to any suitable post in terms of the G.O.Ms.No.98 dated 15.04.1986 is highly illegal, arbitrary, discriminatory, violation of Articles 14, 16, 19, 21 of the Constitution of India and consequently direct the respondent authorities to consider the case of the petitioner for appointment in any suitable post under displaced quota as per G.O.Ms.No.98 dated 15.04.1986 by disposing the representation dated 12.03.2024 and to pass such other order or orders…” 2. Heard Sri K.Srinivasa Prasad, learned counsel for the petitioner and learned Assistant Government Pleader for Services-II appearing on behalf of respondents. 3. The petitioner’s family is residing at Jangamarajupalli Village, B.Mattam Mandal, and was affected by construction of Sri Potuluri Veerabhramendra Swamy Reservoir, in pursuance of which, lands belonging to the petitioner’s family came to be acquired by Award No.2/87 dated 09.03.1987. Property standing in the name of petitioner’s father Sri Nadipi Guraiah, was acquired under the said award. The Government issued G.O.Ms.No.98, Irrigation (PROJ.WING) Department, dated 15.04.1986, by which a policy decision was taken to provide jobs to displaced persons or their dependents and also laid down terms and conditions for making 3 HCGR, J W.P.No.7097 of 2025 such appointments. As the petitioner’s family was affected under aforesaid project, they had been displaced. As such, the petitioner claimed to be beneficiary under the scheme formulated by the Government in terms of G.O.Ms.No.98, Irrigation (PROJ.WING) Department, dated 15.04.1986, and a claim was made before the respondents. The petitioner has submitted representation dated 12.03.2024 to the 3rd respondent to consider his case in terms of G.O.Ms.No.98, Irrigation (PROJ.WING) Department, dated 15.04.1986 and subsequent G.Os., which is stated to be pending. 4. Learned counsel for the petitioner submits that it would suffice to dispose of the writ petition directing the respondents to consider and pass appropriate orders on the representation dated 12.03.2024. 5. Learned Assistant Government Pleader appearing for respondents, on instructions, submits that the representation of petitioner will be considered, in accordance with law. 6. In view of aforesaid submissions, without expressing any opinion on merits of the matter, the Writ Petition is disposed of, directing respondent No.3 to pass appropriate orders on petitioner’s representation dated 12.03.2024, by considering eligibility in terms of G.O.Ms.No.98, Irrigation (PROJ.WING) Department, dated 4 HCGR, J W.P.No.7097 of 2025 15.04.1986, within a period of eight (08) weeks from the date of receipt of a copy of this order.
