(2) Petitioner is aggrieved by a recovery citation issued by Tehsildar, Rudrapur on 24.6.2025 for recovery of ₹36,25,756/-. The said recovery citation was issued pursuant to recovery certificate issued by Mandi Samiti, Rudrapur. (3) Learned Counsel for the petitioner submits that even though petitioner was a partner in a firm with his brother which was running a rice mill, however petitioner was no more a partner in the said firm after 19.6.2019, therefore petitioner is not liable to pay any dues pending against the said firm. (4) Learned Counsel for the Mandi Samiti, however, submits that the pending dues are regarding financial year 2014-15, 2015-16 and 2016-17, when petitioner was still a partner, as per his own admission. (5) Learned Counsel for the petitioner submits that petitioner has made a representation on 6.9.2025, which is Annexure-5 to the writ petition, to Secretary Incharge of the Mandi Samiti, who may be directed to take decision thereupon. (6) Accordingly, writ petition is disposed with a direction to the Secretary 2025:UHC:8661 Incharge of the Mandi Samiti, Rudrapur to consider and decide petitioner’s representation, as per law, within six weeks from today. (7) For a period of six weeks or till the decision is taken, whichever is earlier, no coercive action shall be taken qua the petitioner. However, recovery proceedings shall continue against the firm.
