( 2025:JHHC:12198 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI
B.A. No. 3191 of 2025
------ Amit Kumar Tudu, aged about 38 years, S/o Ramlal Tudu, R/o Benagoria, Nirsa-cum-Chirkunda, P.O. & P.S. Nirsa, Dist. Dhanbad.
… Petitioner
Versus The State of Jharkhand … Opposite Party
------
CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY
------
For the Petitioner : Mr. Shailesh Kr. Singh, Advocate
: Mr. Abhijeet Kr. Singh, Advocate For the State
: Mr. Shree Prakash Jha, Addl. P.P. ------
Order No.02 Dated- 23.04.2025
Heard the parties.
The petitioner has moved this Court for grant of bail in connection with Nirsa P.S. Case No.393 of 2023 (S.T. Case No. 337 of 2024) registered for the offences punishable under sections 304B/34 of the Indian Penal Code.
The learned counsel for the petitioner submits that this is the second journey of the petitioner for grant of regular bail. It is next submitted that earlier the prayer for bail of the petitioner was rejected by a Co-ordinate Bench of this Court vide order dated 04.09.2024 in B.A. No. 6131 of 2024 and the only fresh ground is that the co-accused father of the petitioner has been admitted to bail. Hence, it is submitted that the petitioner be also admitted to bail.
The learned Addl. P.P. opposes the prayer for bail.
Considering the fact that the petitioner is the husband of the deceased and there is direct allegation against him of committing dowry death of his wife as well as the fact that his prayer for regular bail has already been rejected on merit, this Court is not inclined to admit the above-named petitioner on bail.
Accordingly, the prayer for bail of the above-named petitioner is rejected for the same reasons as mentioned in the order dated 04.09.2024 in B.A. No. 6131 of 2024.
