2025:JHHC:12942 IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No. 2588 of 2025 ----- 1.Rohit Kumar @ Bheghu Mahto, S/o Gopal Mahto 2.Lalit Kumar @ Lalit Mahto, S/o Bhuwan Mahto Both are R/o Village- Chouphand, P.S. & P.S.- Baidhmara, District- Bokaro, Jharkhand .... Petitioner(s). Versus The State of Jharkhand … Opp. Party(s). ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Mukesh Kumar, Advocate For the State : Mr. Saket Kumar, Addl.P.P. …...... 02/ 30.04.2025: Heard, learned counsel for the parties. 2. This is an application filed by the petitioners praying for grant of anticipatory bail in terms of Sections 482 and 484 of Bharatiya Nagarik Suraksha Sanhita, 2023 apprehending their arrest for the offences under Sections 126(2), 127(3), 117(2), 109, 303(2), 324(4), 324(5), 3(5) of Bharatiya Nyaya Sanhita, 2023. 3. There is an allegation against this petitioner and others of assaulting the informant and his son who were enjoying picnic. 4. Learned counsel for the petitioners submits that there is no specific allegation against these two petitioners. Rather the allegation of assault is upon the others. 5. After going through the impugned order, I find that there is allegation that this petitioner and others were present there and they were instrumental in assaulting the informant and others, who sustained grievous injuries. 6. Considering the fact that there is direct allegation of assault and injuries sustained is grievous, I find that this is not a fit case for grant of anticipatory bail to the petitioners. Accordingly, the prayer for anticipatory bail of the petitioners in connection with Harla P.S. Case No.02 of 2025, pending in the court of learned J.M. 1st Class, Bokaro, stands rejected.
