The applicant has preferred this First Bail Application under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 176/2024, registered at Police Station : Ramanujganj District- Balrampur-Ramanujganj (C.G.) for the offence punishable under Sections 309(6), 310(6), 311 and 312 of BNSS and Section 25 and 27 of Arms Act. 2. From perusal of the bail application, it transpires that the present KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN 2 bail application suffers from various defects as pointed out by the Registry of this Court and on a pointed query being made to the counsel for the applicant as to why he has filed a defective bail application, he failed to give any satisfactory explanation. 3. In view of the same, learned counsel for the applicant prays to withdraw the present bail application, with liberty to file afresh. 4. Accordingly, this bail application is dismissed as withdrawn, with liberty to file afresh, subject to deposit a sum of Rs.2,000/- as cost by the applicant in the Registry of this Court within a period of one week from today and the same shall be transmitted to the Government Special School for Intellectually Retarded Girls, Gaganpur, Ambikapur, District- Surguja. 5. Learned counsel for the non-applicant / State is present. 6. Certified copy of the documents annexed in the bail application, if any, may be returned back to the counsel for the applicant after obtaining the photocopy of the same, subject to deposit of the fine amount.
