1. This intra Court appeal is directed against interim order dated07.10.2024, passed by the learned Single Bench of this Court [“Writ Court”] in WP(C) No. 2247/2024, titled
“Showkat Ahmad Chack & Anr. Vs. UT of J&K & Ors.” whereby the Writ Court has by way of an interim arrangement stayed notice dated 09.09.2024, issued by Group Senior Manager.
2. On this appeal coming up for consideration, this Court vide order dated 21.10.2024 while issuing notice to the respondents also provided by way of an interim order
that the appointment orders, if any, issued by NHPC pursuant to the notice dated 09.07.2024, impugned in the writ petition shall remain subject to the outcome of the writ petition. The aforesaid interim directions, are in operations ever since.
3. Mr. G.N. Monga,
learned counsel appearing for respondent Nos. 5 & 6 submits that NHPC has proceeded with the selection process and in as many as 52 persons have already been appointed and their appointments kept subject to outcome of the writ petition.
4. In view of the aforesaid and having regard to the nature of controversy involved, this appeal is disposed of by providing that the order passed on 21.10.2024, in this appeal shall serve as interim order in the writ petition till the Writ Court consider and decide the petition.
5. This order is in supersession of the interim order passed by the Writ Court.
