The Court made the following Order:
Learned counsel appearing for the petitioners submits that the petitioners are arraigned as Accused No.3 & 4 in S.C.No.185 of 2023 on the file of learned Principal District Sessions Judge, Ananthapur, for the alleged offences punishable under Sections 420, 506 read with 34 of IPC, Section 56 of Andhra Pradesh Chit Fund Act, Section 5 of Andhra Pradesh Protection of Depositors of Financial Establishment Act.
2. It is alleged that the petitioner’s daughter was running a chit business and only allegation against the petitioners is that the petitioners are threatened the De-facto complainant.
3. Perused the record.
4. The 1st petitioner is aged about 80 years and is arraigned as accused No.3. The 2nd petitioner/Accused No.4 is daughter of Accused No.1 and she has no role in conducting the alleged business.
5. Considering the same, this Court deems it appropriate to dispose of the quash petition, dispensing with the presence of the petitioners/Accused Nos. 3 & 4 before the learned Principal

District Sessions Judge, Ananthapur, in S.C.No.185 of 2023, subject to the petitioners submitting an undertaking to the learned District Judge to appear as and when required for the purpose of trial.
4. Accordingly, the Criminal Petition is disposed of.
As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
