2. Mr. Suyash Pant, Standing Counsel for the State of Uttarakhand / respondent nos. 1 to 7.
3. Petitioner applied for allotment of a fair price shop, however, name of respondent no. 8 has been recommended by the Supply Inspector. Thus, feeling aggrieved, petitioner has approached this Court.

Learned counsel for the petitioner submits that respondent no. 8 was not having status certificate and character certificate on the date of selection, therefore, he is ineligible.
5. Learned State Counsel, however, submits that the writ petition is premature, as decision is yet to be taken by the District Magistrate regarding the person, who has to be given the licence for running fair price shop.
6. This Court finds substance in the said submission. The matter is still under
consideration of the competent authority and mere recommendation does not create any right in favour of anyone. If petitioner has anything to say, it can be said before the District Magistrate.
7. Accordingly, writ petition is dismissed with liberty to petitioner to approach the District Magistrate, by filing objection.
