Neutral Citation No. - 2025:AHC-LKO:14248 Court No. - 15 Case :- CRIMINAL MISC. ANTICIPATORY BAIL APPLICATION U/S 482 BNSS No. - 5 of 2025 Applicant :- Chand Ali Opposite Party :- State Of U.P. Thru. Prin. Secy./Addl. Chief Secy. Home And Another Counsel for Applicant :- Umesh Singh Counsel for Opposite Party :- G.A. Hon'ble Shree Prakash Singh,J. Notice was issued to opposite party No. 2 and that has been duly served upon him but when the case is called out, no one is present, however, learned A.G.A. for the State is present. In the aforesaid circumstances of the case, this Court is proceeding to hear the case. Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record. The instant anticipatory bail application has been filed on behalf of the applicant with the prayer to release him on anticipatory bail in Case Crime No. 0613 of 2024, under sections 191(2), 109, 74, 115(2), 352, 351(3) BNS, Police Station- Kotwali Akbarpur, District- Ambedkar Nagar. The contention of learned counsel for the applicant is that the applicant is innocent and has falsely been implicated in the instant matter due to ulterior motive. He submits that the applicant is not named in the FIR. He also submits that there is apprehension that the applicant will be arrested by the police, thus, submission is that he may be granted anticipatory bail. On the other hand, learned A.G.A. appearing for the State has opposed the
submissions aforesaid and submits that the applicant is involved in committing the offence, as such, he is not entitled to be released on anticipatory bail. From a perusal of the FIR, and the other relevant document placed on record, it is apparent that the applicant is named in the FIR and the injured persons have also named the applicant regarding his involvement in the offence. There are many persons injured and they have received severe injuries including lacerated wound over the body and the head. Thus, this Court do not find any fit case to grant bail to the accused-applicant. Consequently, the present bail application is hereby rejected.
