24.02.2025 41 sdas Rejected C.R.M. (A) No. 642 of 2025 In Re:- An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita in connection with Bidhannagar Cyber Police Station Case No. 70 of 2024 dated 04.04.2024 under Sections 419/420/406/467/468/471/ 34/120B of the Indian Penal Code. And In Re : Manoj Kumar Shaw .….. petitioner Mr. Sourav Chatterjee Mr. Sourat Nandy ..…for the petitioner Ms. Sana Naaz ….. for the State 1. Learned Counsel for the petitioner submits he has co-operated with investigation. He has been falsely implicated in the case. He prays for anticipatory bail. 2. Learned Counsel for the State opposes the prayer for anticipatory bail and submits petitioner is the member of a gang which indulged in cyber fraud and induced individuals to part with money on the false promise of setting-up mobile towers. 3. We have considered the materials on record. Petitioner is the member of an organized crime racket who falsely induced unsuspected individuals to part with money on the false promise of setting-up mobile towers. Some of the accused have similar criminal antecedents. Custodial interrogation of the petitioner is essential for unraveling 2 ramifications of the crime which partakes an organized crime activity. Accordingly, we are of the opinion this is not a fit case to grant anticipatory bail to the petitioner. 4. Accordingly, prayer for anticipatory bail is rejected. (Gaurang Kanth, J.)
