PUBLIC PROSECUTOR The Court made the following: ORDER:- This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the petitioners/A1 to A3, seeking regular bail, in Crime No.87 of 2024-25 of Onipenta Range. 2. A case has been registered against the petitioners herein for the offences punishable under Sections 20(1)(c) ii, iii, iv, vi, x r/w 20(1)(d), 32A, 32B r/w 36, 44 of AP Foresh (Amendment) Act, 2016, Section 58 Rule 3 of A.P.Sandal Wood Possession Rules, 1989, Section 303(1) of BNS. 2 3. The brief facts of the case are that this is a case of criminal conspiracy, criminal trespass into restricted reserve forest without any permission, committing theft of red sanders by cutting live red sander trees, shifting from foresh, dumping for the purpose of smuggling illegally that occurred on 02.02.2025 at 2.15 p.m., at Ark Cheruvu Konda Locality, Ganjikuna Beat, Balappabavi West Beat, in which A1 to A3 were arrested and 3 red sander logs, weighting 56.900 kgs were seized from their possession. 4. Heard. Perused the record. 5. Learned Assistant Public Prosecutor, while opposing the prayer of the petitioners on the ground that the petitioners have been involved in six other cases and the investigation has not completed and prays to dismiss the petition. 6. Learned counsel for the petitioner submits that the crime came to be registered on 02.02.2025 and police arrested A1 to A3 on the same and since then petitioners/A1 to A3 is in judicial remand. 7. After careful observation of the material on record and submissions made on behalf of both sides, even though the petitioners were arrested on 02.02.2025, but the investigation 3 has not completed and the petitioners are involved in similar six other cases, this Court is not inclined to grant bail to the petitioner at this stage. 8.
