Petitioner seeks change in his gender as mentioned in the High School and Intermediate Marksheet issued by U.P. Secondary Education Board on 08.06.2013 and 17.05.2015 respectively. Petitioner was earlier a female and has undergone change of gender. Certificate as referred in Section 6 of the Transgender Persons (Protection of Rights) Act, 2019 (in short 'the Act, 2019') has been issued to the petitioner on 10.01.2023. Certificate under Section 7 of the Act, 2019 has been issued to the petitioner on 11.05.2023. Petitioner relies upon sub-Section -3 of Section 7 of the Act, 2019 to seek a change in gender mentioned in High School as well as Intermediate marksheets. 3. Let the petitioner's application under Section 7(3) of the Act, 2019 be considered by opposite party no.2 and a decision be taken in this regard at the earliest say within six weeks. We make it clear that we have not adjudicated applicability of sub- Section 3 of Section 7 of the Act, 2019 to the facts of this case nor veracity of the certificates referred hereinabove which may be seen by the Board. 4.
