Sri Adnan Ahmad, learned counsel for the petitioners states that he has no instructions in the matter. 2. The present petition has been filed challenging the orders whereby the SCC suit was dismissed and the revision was also dismissed. 3. Considering the fact that U.P. Act No. XIII of 1972 has been repealed, the present petition is disposed of permitting the petitioner to file fresh proceedings, if so advised, under the Tenancy Act of 2021. In case, a fresh proceedings are filed, the same shall be decided within the time prescribed in the statute. The order impugned in the present petition shall not come in the way in deciding the application on its own merits in accordance with law. 4.
