Learned counsel for appellant and Shri Karunakar Srivastava, learned counsel for respondent are present. 3. Despite repeated request made by the court, learned counsel for the appellant is not ready to argue the matter. On the last date i.e. 30.01.2025, an order was passed that 'It is made clear that on the next date of listing, the case shall not be adjourned on any ground, whatsoever, as it is an old case'. The said order is quoted hereinbelow:- "Despite the request of this Court to argue the case as it pertains to the year 1998, learned counsel for the appellant has shown his inability to argue the case submitting that he is not well prepared with the case and prays for adjournment of the case. List this case again. It is made clear that on the next date of listing, the case shall not be adjourned on any ground whatsoever as it is an old case pertaining to the year 1998. " 4. The ordersheet reveals that on 02.08.2024, learned counsel for appellant had sent his illness slip and the matter was adjourned. On 03.10.2024, the case was adjourned on the request of learned counsel for appellant that he is not prepared with the case and lastly, on 30.01.2025 an order was passed which is quoted hereinabove, the court asked repeatedly to argue the case, but he only prayed for adjournment of the case. 5. In view of the earlier order passed as mentioned above and since today also, he is not ready to argue despite the request made to him to argue the case, the present second appeal is dismissed for want of prosecution.
