PUBLIC PROSECUTOR The Court made the following order: 1. Heard the learned counsel for the petitioners and the learned Assistant Public Prosecutor appearing for the State. 2. The learned counsel for the petitioners submits that the petitioners were arraigned as A.1 to A. 14 in Crime No. 18 of 2025 of Bhakarapet police station, Tirupati District, registered for the alleged offences under Sections 189(2), 191(2), 191(3), -2- CRLP. No.2839 of 2025 119(1), 118(1), 115(2), 324(4), 351(2) read with Section 190 of the Bharatiya Nyaya Sanhita, 2023 [hereinafter referred to as ‘B.N.S.’], based on the complaint of the 2"^^ respondent. 3. The learned counsel further submits that Section 119(1) of B.N.S. is not applicable to the present facts of the case, as the complaint does not disclose extortion. It is also submitted that a civil suit, O.S. No.93 of 2025 on the file of Principal Junior Civil Judge, Filer, has been filed by the 2""^ respondent seeking injunction against the petitioners’ family members, and the same is pending consideration. 4. The learned counsel further submits that it is alleged in the complaint that the petitioners trespassed into the property and assaulted the 2"'^ respondent along with her relatives. 5. The learned Assistant Public Prosecutor representing the State submits that during the attack, the 2"*^ respondent sustained bleeding injuries and was hospitalized, while the other victims reportedly suffered minor injuries in the incident. 6. Considering the submission of the learned counsel for the petitioners that Section 119(1) of B.N.S. is not applicable to the present facts of the case, this Court deems it appropriate to dispose of the criminal petition directing the Station House an -2- CRLP. No.2839 of 2025 Officer, Bhakarapet Police Station, Tirupati District, to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, for the purpose of investigation in connection with Crime No. 18 of 2025. 7.
