By means of present petition, filed under Article 226 of the Constitution, petitioner wants consideration of his representation by respondent no. 4 for correcting his date of birth, which is recorded in the official record as 1.1.1965 and according to him, his correct date of birth is 15.2.1968. It is contended by learned Standing Counsel that petitioner has already retired in the year 31.12.2023 and now his date of birth cannot be directed to be corrected . In view of above, therefore, the issue involved in the matter of change of date of birth under the U.P. Recruitment to Services (Determination of Date of Birth) Rules, 1974 , such date of birth cannot be directed to be corrected which is originally recorded in the official records except in exceptional circumstances. He has placed reliance upon the recent authority of this Court in the case of Smt. Kavita Kureel vs. State of U.P. and others in Writ-A No. 9226 of 2023. In view of above, I do not find any merit in the submission advanced by learned counsel forthe petitioner. Petition fails and is accordingly dismissed.
