Heard learned counsel for the petitioner and Shri Vashu Deo Mishra, learned counsel for the respondent no.3. 2. Present petition has been filed against the order dated 05.02.2008 passed in Rent Revision No.3 of 2007 whereby the matter was remanded to the Rent Control and Eviction Officer for declaring vacancy afresh ignoring the reports of the Rent Control Inspector. 3. As the said order was passed on 05.02.2008, I do not see any reason to interfere, particularly, when the order is that of remand. 4. It is also noticeable that the Rent Control Act has been repealed by means of U.P. Regulation of Urban Premises Tenancy Act, 2021. 5. In view of the said repealment, no further orders can be passed under the erstwhile Act. The petitioner would be at liberty to initiate proceedings in accordance with the 2021 Act, if so advised, in accordance with law. 6. Present petition is accordingly dismissed in above terms.
