United India Ins. Co. vs. Surender Kumar
FAO No. 153 of 2022 19.06.2025 Present: Dr. Lalit K. Sharma, Advocate for the appellant. Ms. Anchal, Advocate vice Mr. Balwant Singh Thakur, Advocate for respondents No.1 and 2. Mr. Sumit, Advocate vice Mr. Bhagwati Chander Verma, Advocate for respondents No.3 to 6. CMP No.9607 of 2025 This application has been filed on behalf of applicant/respondent No.1 for release of 50% of amount of compensation.
Learned counsel for non-applicant/Insurance Company has opposed the release of amount on the ground that at the time of final hearing, there is every likelihood of reduction of amount of compensation awarded in favour of applicant/respondent No.1
Learned counsel for applicant/respondent No.1 submits that the applicant/claimant/respondent No.1 is agitating for getting the just and fair compensation since long, but in vain. Balancing the interest between the parties, at this stage, 30% of the amount of compensation falling in the share of applicant/respondent No.1 along with proportionate interest thereon is ordered to be released in favour of applicant/respondent No.1 by remitting the aforesaid amount in the bank account of applicant/respondent No.1, referred in para 4 of application. Photocopy of front page of pass book has also been placed on record.
The aforesaid release shall be subject to final outcome of appeal and in case, excess amount has been released in favour of applicant/respondent No.1, he shall be liable to refund the same along with appropriate interest awarded by the Court. Application is allowed and disposed of. June 19, 2025
