Neutral Citation No. - 2025:AHC-LKO:1877 Court No. - 19 Case :- WRIT - C No. - 43 of 2025 Petitioner :- Dr. Vijay Ayurvedic Medical College, Hospital And Research Centre Thru. Its Dirr. Vijay Kumar Yadav Respondent :- The Union Of India Thru. Its Secy., Ministry Of Ayush, New Delhi And Others Counsel for Petitioner :- Ishan Baghel,Nishchal Verma Counsel for Respondent :- A.S.G.I.,C.S.C.,Devak Vardhan,Umesh Singh Hon'ble Manish Mathur,J. 1. Heard learned counsel for petitioner, Mr. S.P. Singh, learned Additional Solicitor General of India assisted by Mr. Umesh Singh, learned counsel for opposite party no. 1-Union of India, learned State Counsel for opposite parties no. 2, 5 & 6 and Mr. Devak Vardhan, learned counsel for opposite parties no. 3 & 4. 2. Petition has been filed seeking a direction to concerned authority to conduct a special stray vacancy round of counselling for filling 12 seats allotted to petitioner's institute in terms of order dated 25.11.2024. 3. Earlier on 06.01.2025, the following order had been passed:- "1. Heard learned counsel for petitioner, learned State Counsel as well as Mr. Umesh Singh, learned counsel for Union of India and Mr. Dheeraj Awasthi Advocate holding brief on behalf of Mr. Devak Vardhan, learned counsel for opposite party no. 3 and 4. 2. In pursuance of directions issued earlier, learned State Counsel has been provided written instructions dated 03.01.2025, a copy of which is taken on record. 3. From the material placed on record, it is evident that petitioner had earlier also filed Writ-C No. 11380 of 2024 seeking a direction to authorities concerned for expeditious disposal of second appeal dated 26.09.2024 with regard to penalty imposed upon petitioner institution for purposes of U.G. B.A.M.S. Course. The said petition was disposed of vide order dated 20.12.2024 and in pursuance of which, the National Commission for Indian System of Medicine by means of order dated 26.12.2024 revised conditional permission granted to petitioner institution increasing the intake capacity by 12 seats. 4. It appears that information with regard to such increase of seats was conveyed to concerned authority on 26.12.2024 at 05:41 PM. It also appears that a stray round of counselling was slated to be held on 30.12.2024 but for which last date for choice/options was from 24.12.2024 till 26.12.2024 by 01:00 PM. It appears that intimation with regard to intake of petitioner's seats was communicated to the relevant authority belatedly, due to which petitioner's institution was not included in the stray round of counselling held on 30.12.2024. 5. It has been submitted by learned counsel for petitioner that there are a number of students still indicated in the waiting list who have not been allocated any college. 6. In view of aforesaid facts and circumstances, learned State Counsel as well as learned counsel for Union of India is granted three days' time to seek instructions as to whether any fresh special stray counselling can be held for petitioner's institution. 10. List this case on 10.01.2025, as fresh." 4. In pursuance of directions issued earlier, learned State Counsel has been provided written instructions dated 09.01.2025, a copy of which is taken on record and as per which the counselling schedule has been extended uptill 13.01.2025 by the N.C.I.S.M. New Delhi. It is, therefore, submitted that due to extension of the conselling process, petitioner's institute can be permitted to participate in the second stray round of counselling for the course in question. 5. In view of such submission of learned State Counsel, the opposite parties no. 5 & 6 are directed to permit petitioner's institute to participate in the second stray round of counselling for U.G. B.A.M.S. Course for the academic session 2024-25 scheduled till 13.01.2025. 6. With aforesaid directions, petition stands disposed of.
