Addl. Prin. Secy., Secondary. Education Lko. And 4 Others Counsel for Petitioner :- Shrikant Mishra,Ubhai Kumar Singh Counsel for Respondent :- C.S.C. Hon'ble Manish Mathur,J.
1. Heard learned counsel for petitioner and learned State Counsel for opposite parties no.1 to 4.
2. In view of order being passed, notices to opposite party no.5 stand dispensed with.
3. Petition has been filed seeking a direction to opposite
parties
for
consideration
of objections/complaints made by another member and petitioner dated 24.03.2015 and 17.12.2024 respectively with regard to list of members of Siksha Vikas Samiti, Kauria, District Gonda submitted by one Kaushal Kishore Shukla (alleged Manager of Janta Enter College, Kauria Gonda).
4. Mr. Pankaj Srivastava, learned State counsel at the very outset has raised a preliminary objection regarding maintainability of this petition in view of the fact that as per instructions received by him on Whats-app, there is no complaint or objection filed by petitioner against the list of members of the Samiti submitted by Kaushal Kishore Shukla, who even otherwise has not been made a party to the writ petition. It is therefore submitted that the petition is liable to be rejected on the grounds of non-joinder of necessary party.
5. It is also submitted that the list which has been allegedly challenged by petitioner in fact has already been approved in the year 2013 and there is no cogent explanation by petitioner for laches in challenging the list after 11 years. It is also submitted that the objections dated 24.03.2015 have been filed by another member who has not pursued the same. It is submitted that another application had been filed by one Rampher
Tripathi, which was also not pursued.
6. It is also submitted that the alleged objection brought on record as Annexure no.15 to the writ petition does not contain any dates or even signatures of the complainants and as per instruction has not been received in the ofÏce of the Deputy Registrar.
7. Learned counsel for petitioner however submits that there are in fact objections pending against the aforesaid approved the list which have not been decided till date. He has also submitted that petition earlier could not be filed since an authorized controller was appointed for the college concerned and is still continuing as such.
8. However considering objections raised by learned State Counsel, this Court does not find any occasion to entertain this petition at this stage, particularly since there does not appear to be any objections received by opposite parties on behalf of petitioner.
9. In view of aforesaid submission, petition is dismissed. Parties to bear their own costs.
