Instant revision has been filed by the revisionist for setting aside the order dated 13.02.2025 passed by the learned Special Judge (NDPS Act)/First Additional District & Session Judge, Udham Singh Nagar in Miscellaneous Release Application No.51 of 2025 State vs. Kundan Singh whereby the learned court has rejected the release of the vehicle with registration no.UK 19 CA 1171 in favour of revisionist no.1 and further prayer has been made to direct the learned Special Judge (NDPS Act)/First Additional District & Sessions Judge, Udham Singh Nagar court to release the vehicle with registration no.UK 19 CA1171 in favour of the revisionist no.1 being registered owner of said vehicle. 4. Learned counsel for the revisionist submits that revisionist no.1 and revisionist no.2 entered in an agreement to sell of the vehicle in question with the terms and conditions as mentioned in the agreement but revisionist no.1 remained the owner of the vehicle as the vehicle was on loan and monthly instalments were pending thereby it was orally agreed that the vehicle will only be transferred when all the instalments of the loan will be paid. Thus, the vehicle remained registered, in control and possession of the revisionist no.1. 5. Learned counsel for the revisionists submits that revisionists are suffering great hardship after seizure of the vehicle as they have paid monthly instalments of loan but they are unable to use the same. He further submits that revisionists are ready to co-operate in the investigation. 6. Having heard learned counsel for the parties and after considering the facts and circumstance of the case, the instant revision is disposed of with the condition that revisionists shall furnish two local sureties and a personal bond before the court concerned. 7. It is made clear that the said vehicle may not be modified and not be changed hands in favour of the registered owner verified by the concerned police station. 8. Pending applications, if any, stand disposed of.
