IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI (Special Original Jurisdiction) [3331] THURSDAY, THE NINETEENTH DAY OF JUNE TWO THOUSAND AND TWENTY FIVE PRESENT THE HONOURABLE SRI JUSTICE SUBBA REDDY SATTI CONTEMPT CASE NO: 868/2025 Between: G. Heera Naik ...PETITIONER AND B Rajsekhar ...CONTEMNOR Counsel for the Petitioner:
1. SYED KHADER MASTAN Counsel for the Contemnor:
1. G RAJU The Court made the following:
:: ORDER ::
The above contempt case is filed complaining about the non- implementation of the order dated 29.01.2025 in W.P.No.17440 of 2024.
2. Heard learned counsel appearing on either side.
3. W.P.No.17440 of 2024 was disposed of, at the stage of admission with the consent of both the counsel, directing the learned the respondent No.1 therein to consider the case of the petitioner for promotion, strictly in terms of
SRS,J C.C.No.868 of 2025
G.O.Ms.No.257 General Administration (Ser.C) Department, dated
10.06.1999.
4. In the affidavit, it was contended that the respondents failed to comply with the order passed by this Court.
5. When the matter is taken up for consideration, Sri K. Varun, learned counsel representing Sri G.L. Narasimha Reddy, learned counsel appearing for the respondent, submitted G.O.Ms.No.4 Animal Husbandry, Dairy Development & Fisheries (Fish) Department, dated 28.02.2025. A perusal of said G.O., it would indicate that the Departmental Promotion Committee approved the names of certain individuals, including the petitioner, for the panel of the Joint Director of Fisheries fit for promotion to the category of the Additional Director of Fisheries, for the panel year 2024-25. However, in respect of the petitioner, in remarks column, it was mentioned that as follows:
“included and promotion be deferred until termination of the disciplinary proceedings pending against him in terms of G.O.Ms.No.424, G.A (Ser.C) Dept., dt:15.04.1976 read with G.O.Ms.No.257 (Ser.C) Dept., dt:10.06.1999”.
6. Thus, as seen from the G.O.Ms.No.4, dated 28.02.2025, a speaking
order was passed. Since a reasoned order was passed, this Court does not find any violation of the order dated 29.01.2025 in W.P.No.17440 of 2024.
7. Given the facts and circumstances of the case, the Contempt Case is dismissed. However, it is open to the petitioner to challenge the speaking
order if aggrieved. No order as to costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
