4. Petitioner has challenged a notice dated 29.08.2025 issued to him by Executive Engineer, Construction Division, Public Works Department, Haldwani. By the said notice, petitioner was called upon to remove his unauthorised occupation over the Government land, by 15.09.2025.
5. Perusal of the notice indicates that opportunity of personal hearing was given to the petitioner and date for this purpose was fixed on
06.10.2024.
6. Learned counsel for the petitioner then submits that the land in question was leased out in favour of the petitioner and the term of the lease has expired in 2004; petitioner has applied for renewal of lease, therefore, asking the petitioner to remove his occupation, without
2025:UHC:8283 considering the prayer for renewal, is unjust.
7. This Court is not inclined to interfere with the impugned notice. However, the writ petition is disposed of with a direction to the Competent Authority to consider petitioner’s application for renewal of lease made on 21.11.2022 and pass appropriate order, as per law, within two months from the date of production of certified copy of this order.
