This is an application filed by the petitioners praying for grant of anticipatory bail in terms of Sections 482 and 484 of Bharatiya Nagarik Suraksha Sanhita, 2023 apprehending their arrest for the offences under Sections 341, 323, 353, 504 and 34 of IPC. Learned counsel for the State opposes the prayer for anticipatory bail of the petitioners. Learned counsel for the petitioners submits that petitioners are not named in the F.I.R. and there is also no allegation of assaulting the police personal. From the impugned order and F.I.R., I find that these petitioners obstructed the police official from performing their duty, they parked their vehicle in middle of the road to obstruct the motor vehicle inspector from performing his duties. There is general allegation of assaulting the government servant, who is the motor vehicle inspector. Considering the direct nature of allegation, I find that this is not a fit case for grant of anticipatory bail to the petitioners. Accordingly, the prayer for anticipatory bail of the petitioners in connection with Garhwa P.S. Case No.331 of 2023, pending in the Court of learned Court of Chief Judicial Magistrate, Garhwa, stands rejected. R.S./ (ANANDA SEN, J.)
