HON’BLE JUSTICE DR. T. AMARNATH GOUD ORDER 31.07.2025 [1] Heard learned counsel for the respective parties. [2]
This present petition has been filed under Article 226 of the Constitution of India seeking the following reliefs:-
“In view of the above facts and circumstances, your humble petitioner most respectfully prays that this Hon'ble Court may graciously be kind enough to consider the above facts and may be pleased enough to:
a) Direct the Respondents, more specifically, the respondent No.4, to take an expeditious decision on the parole application submitted by the convict Sri Tutan Sarkar in accordance with law; AND b) Directing, commanding the respondent authority to grant temporary release in favor of the convict Sri Tutan Sarkar on parole for a period of 30 (thirty) days enabling him to attend Shradda ceremony of his deceased son, to be held on 18.08.2025 ad/or for any other period permissible under act and Rules.”

It is seen from the record that the husband of the petitioner is in jail suffering an order of conviction dated 22.12.2020 and as per the petitioner on 17.06.2025 their son committed suicide and is dead. Page 2 of 3

It is further contended by the learned counsel for the petitioner that to attend some Shraddha ceremony and family rituals she sought for parole of her convict-husband who is presently lodged in Gonda-Twisa Sub -Jail, Dhalai Tripura, before the concerned authority and, thereafter, a communication was made between the DM & Collector, West Tripura and Inspector General of Prisons vide letter dated 19.07.2025. In the said letter it is indicated that the Shraddha ceremony is 25.07.2025, since the same is not considered the present writ petition is filed. [5]
It is further observed in the writ petition the date of Shraddha ceremony which was earlier fixed on 25.07.2025 has been erased and it is indicated that the same would be held on 18.08.2025 and thus, it has been prayed for parole of the convict person. Since, the matter is pending before the concerned respondent(s), at this juncture, it is not for this Court to adjudicate the same.
[6] In view of the same, without expressing any opinion on the merits of the case, this present writ petition is disposed of directing the concerned respondent(s) to take a decision in light of the aforesaid communication dated 19.07.2025 as expeditiously as possible in accordance with law. With the above observation and direction, this present writ petition stands disposed of. As a sequel, miscellaneous application(s), pending if any, shall stand closed. JUDGE
