The present appeal is directed against impugned judgment of conviction and order of sentence dated 09.04.2008 passed by the Special Judge (constituted under Indian Electricity Act, 2003), Dhamtari (C.G.) in Special Criminal Case No. 57/2007, whereby and whereunder, the appellant stands convicted under Section 135 (1) (A) of Electricity Act, 2003 & sentence to pay fine of Rs.48,100/-, in default 2 thereof to undergo S.I. for 04 months. 2. In pursuance of this Court’s order dated 28.02.2025, bailable warrant was directed to be issued against the appellant and the same has been received with a note that the sole appellant left for heavenly abode on 25.11.2020. 3. The service report of the bailable warrant is supported by the report of S.H.O., Khamtarai, Raipur (C.G.) with the death certificate of the appellant. 4. Learned State counsel has verified the fact and confirms the death of sole appellant. 5. Thus, in view of the death of sole appellant and in absence of any application for bringing his legal representatives on record, the appeal abates and the same is dismissed as abated.
