The matter pertains to the year 1983. The same was dismissed in the year 2013, which was order was recalled on 28.8.2019. Subsequently the matter has been adjourned on the behest of the petitioners either on illness or on sanctioned leave. The matter was listed on 17.9.2019, 25.9.2019, 15.10.2019, 28.1.2020, 27.2.2020, 9.11.2021, 7.12.2021, 17.2.2023, 19.7.2023 and 27.10.2023 and in all dates the matter was adjourned on the behest of the petitioners' counsel either on due to illness slips or due to sanctioned leave. Today again an adjournment has been sought on behalf of Shri Umesh Chandra Pandey. 2. In the aforesaid circumstances, the following order was passed on 23.5.2024:- "1. There is a request for adjournment on behalf of Sri Shivang Tiwari, learned counsel for respondent. He submits that his Vakalatnama is there but his name is not printed in the cause list therefore he could not appear. 3. It is noticed that five counsels have filed their Vakalatnama by means of application filed on 05.01.2024. Name of another counsel Sri Avinash Singh Vishen and his AOR number has also been shown. 4. There is no reason for his non-appearance today. While on the other hand Sri Shivang Tiwari, Advocate has appeared and stating that his name is not showing in the cause list and requests for adjournment of the matter today. 5. Matter pertains to 1983 and in any view of the matter, the name of Sri Avinash Singh Vishen as counsel for respondent is printed, the prayer for adjournment is allowed with a cost of Rs. 500/-. 6. Accordingly, list this case on 10.07.2024. 7. It is made clear that the matter shall not be adjourned on the said date." 3. Accordingly the request for adjournment is rejected.
