SREENIVASA REDDY Criminal Petition No.2832 of 2025 Order: This Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed on behalf of the petitioner herein, to grant anticipatory bail in connection with Crime No.4 of 2025 of Cyber Crime Police Station, Visakhapatnam Commissionerate, registered for the offences punishable under Sections 111(2), 319(2), 318(4) read with 61(2) of the Bharatiya Nyaya Sanhitha, 2023, Sections 66-C and 66-D of the Information Technology Act 2000-2008 and Sections 3 and 4 of the Andhra Pradesh Gaming Act, 1974. 2. Case of the prosecution, in brief, is that on 06.01.2025, at about 08.30 pm, on receipt of credible information about cricket betting, the Inspector of Police, Cyber Crime Police Station, Visakhapatnam Commissionerate, along with his staff and mediators, reached Flat No.610, Gayatri Towers, 0pp. Water tank and pump house, back side of Polamamba Temple, Doctors Colony, Pedawaltair, Visakhapatnam and found A3 with a Laptop and two mobile phones. On enquiry, A3 disclosed his identity ‘S VI 4^ 2 particulars and police seized the said Laptop and two mobile phones, and he disclosed that he used to do cricket betting offline and online by collecting money either online or by way of cash. Police arrested him and got remanded him to judicial custody. 3. Learned counsel for the petitioner submits that though the name of the petitioner herein is not shown as accused in the FIR, the police are trying to implicate him in the present crime, hence the petitioner apprehends his arrest at any point of time. On the other hand, learned Assistant Public Prosecutor submitted that as the petitioner is not shown as accused in the present crime, question of granting anticipatory bail does not 4. arise. 5. Heard. Perused the record. 6. As the petitioner is not arraigned as accused in the present crime, the question of granting anticipatory bail to him does not arise. Hence, this Court is not inclined to grant anticipatory bail to him.- 3 However, since the petitioner apprehends that he may be 7. implicated in the present crime and he may be arrested at any point of time, this Court directs the respondent-police to issue 48 hours’ prior notice to the petitioner herein before taking any coercive action against him in the crime vide FIR No.4 of 2025 of Cyber Crime Police Station, Visakhapatnam Commissionerate. With the above direction, the Criminal Petition is disposed 8. of. As a sequel thereto, the miscellaneous petitions, if any pending in this Criminal Petition, shall stand closed.
