Mr. Hemant Singh Dangwal, learned counsel for respondent No.3. 4. Delay in filing the counter affidavit is condoned. Counter affidavit filed by the State is taken on record. Delay condonation application (IA/3/2024) made therefor, is allowed. 5. By means of the present criminal writ petition, petitioner has challenged the FIR No.159 of 2024 dated 29.08.2024 registered with P.S. Nanakmatta, District Udham Singh Nagar, under Sections 106(1) and 281 of B.N.S. Act, 2023, on the ground of a compromise intend to between the petitioner and respondent No.3. 6. Since, in this episode, the minor son of respondent No.3 was killed in a bus accident. The said bus No.UK 6 PA 0728 was driven by the petitioner. 7. In the opinion of this Court, since the minor son of respondent No.3 has lost his life, therefore, respondent No.3 has no right to compound the matter with the petitioner. 8. Accordingly, the compounding application (IA/1/2024) is rejected. 9. In view of the above, the criminal writ petition is dismissed. 10. Interim order dated 06.12.2024 stands vacated.
