In compliance of the earlier orders passed by this Court, the Chief Judicial Magistrate Sitapur has sent a report dated 31.05.2025. We have gone through the said report sent by the C.J.M. Sitapur wherein it has been stated that the sole appellant- Vimal Kumar @ Pappu had died during the pendency of the Appeal. The statements of the Village Pradhan, the Sub Inspector of the Police Station concerned and also of the family members of the deceased appellant, have been enclosed to the said report. Since the sole appellant- Vimal Kumar @ Pappu, has died during the pendency of the Appeal, the instant Appeal is liable to be dismissed as abated.
